Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity.)

Right of Withdrawal

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day

  • on which you or a third party named by you, who is not the carrier, have taken possession of the goods, if you have ordered one or more goods as part of a uniform order and these are delivered uniformly, or
  • on which you or a third party named by you, who is not the carrier, have taken possession of the last goods, if you have ordered several goods as part of a uniform order and these are delivered separately, or
  • on which you or a third party named by you, who is not the carrier, have taken possession of the last partial shipment or the last piece, if you have ordered goods that are delivered in several partial shipments or pieces, or
  • on which you or a third party named by you, who is not the carrier, have taken possession of the first goods, if you have concluded a contract for the regular delivery of goods over a fixed period of time.

To exercise your right of cancellation, you must inform us (Weingut Frischengruber, Am Platzl 19, 3602 Rührsdorf, Austria, phone number: +43 664 886 712 91, email address: wein@frischengruber.at) of your decision to cancel this contract by means of a clear statement (e.g. a letter sent by post, email). You may use the attached model cancellation form, but it is not obligatory. You can also electronically fill out and submit the model cancellation form or any other clear statement on our website https://www.frischengruber.at/widerrufsbelehrung/. If you use this option, we will immediately send you a confirmation of receipt of such a cancellation (e.g. by email).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you cancel this contract, we will reimburse all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choosing a type of delivery other than the least expensive type of standard delivery offered by us), immediately and no later than fourteen days from the day on which we received the notification of your cancellation of this contract. For this reimbursement, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You must send back or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion of the Right of Withdrawal

The right of cancellation does not exist according to § 312g para. 2 BGB for:

  • Contracts for the delivery of alcoholic beverages, the price of which was agreed upon at the time of concluding the contract, but which can be delivered at the earliest 30 days after the conclusion of the contract and whose current value depends on fluctuations in the market over which the entrepreneur has no influence
  • Contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery
